1. Introduction Welcome to the ASEAN Fire Alert PhoneApps Tool (“App”). These Terms and Conditions (“Terms”) govern the use of the App and its services. By downloading, accessing, or using the App, you agree to be bound by these Terms.

2. Use of the Application (App) The App is freely available to the public for personal, non-commercial use, subject to these Terms. Users must not misuse or abuse the data provided by the App.

3. User Accounts

3.1 Registration The App is accessible in all ASEAN countries, including but not limited to Brunei Darussalam, Cambodia, Indonesia, Lao PDR, Malaysia, Myanmar, Philippines, Singapore, Thailand, and Vietnam. Users can set preferences to receive updates for specific regions.

3.2 Account Security Users are responsible for maintaining the confidentiality of their account credentials and all activities associated with their accounts. Any unauthorized use should be reported immediately to contact@aseanfirealert.org.

4. Prohibited Conduct Users must not engage in the following activities:

  • Violating any applicable laws or regulations.

  • Using the App for illegal or unauthorized purposes.

  • Interfering with or disrupting the App or its servers.

  • Conducting any activities that could harm or impair the App’s functionality or performance.

5. Intellectual Property

5.1 Ownership All intellectual property rights, including text, graphics, logos, and software, belong to the MAHFSA Programme. Data such as ASEAN Hotspots, Fire Danger Rating System (FDRS), rainfall, and weather updates are publicly available for dissemination.

5.2 Restrictions Users may not reproduce, modify, create derivative works of, publicly display, or exploit any part of the App without prior written consent from the MAHFSA Programme.

6. Privacy Personal information, including profile photos, will not be shared with third parties unless specified in the App. User-submitted content, such as text, coordinates, and photos under the “Create Report” section, may be used by relevant agencies for credibility assessment. By using the App, users consent to the collection and use of their information per these Terms.

7. Termination The App reserves the right to terminate or suspend user access at any time without prior notice or liability for any reason, including violations of these Terms. Upon termination, users must cease using the App.

8. Disclaimer of Warranties The App is provided “as is” and “as available” without any warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.

9. Limitation of Liability MAHFSA Programme and its partners shall not be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill resulting from the use of the App.

10. Governing Law These Terms are governed by the laws of Brunei Darussalam, Cambodia, Indonesia, Lao PDR, Malaysia, Myanmar, Philippines, Singapore, Thailand, and Vietnam, without regard to conflict of law provisions.

11. Changes to These Terms The App reserves the right to modify or replace these Terms at any time. Material changes will be notified at least 15 days before they take effect. The determination of material changes is at the sole discretion of the developer.
